DURHAM, District Judge: The defendant was originally charged with second degree murder, a first degree felony, to which he pled not guilty and not guilty by reason of insanity. Plea negotiations ensued between defendant, who was represented by counsel, and the State, which resulted in the filing of an amended information charging manslaughter, a second degree felony. The defendant entered a plea of guilty to the charge in the amended information, and was subsequently sentenced to a term of from one to fifteen years in the Utah State Prison. Prior to sentencing, but after an indication from the trial Judge that he would not place the defendant on probation, the defendant moved to withdraw his plea of guilty. That motion was denied, and defendant seeks a review of that ruling and the sentence, and an order from this Court that would require either the withdrawal of his plea and a trial or a suspended sentence with probation.
